    The list below contains some of the major waivers andsuspensions of Texas laws and regulations that might affect the apartmentindustry, as well as some resources and guidance for apartment communitiesaffected by Hurricane Harvey.  The listis not exhaustive, due to the fact that many waivers and suspensions that havebeen granted were not provided in writing or were granted on an individualcase-by-case basis. Please use this as a guide only. Before relying on anyparticular waiver or suspension, the proclamation or order granting the waiveror suspension should be reviewed.   Proclamations from the Office of theTexas Governor Harris and surrounding counties have been declared a disasterarea due to damage caused by Hurricane Harvey. The declaration of disaster allows the suspension of regulations thatwould in any way prevent, hinder or delay necessary action in coping with thedisaster upon written approval of the Governor’s office.  The disaster declaration was extended foranother 30 days on November 19, 2017.  Regulations regarding utility connections and property accesshave been waived to allow for creation of temporary utility connections andease of access to utility lines to facilitate repair.  The attorney general has been instructed to investigate andprosecute claims of price gouging related to the Hurricane Harvey reliefeffort.  Suspected price gouging on thepart of vendors helping with remediation efforts should be reported to theOffice of the Attorney General.   • Fire Extinguisher Recall December 14, 2019

    The U.S. Consumer Product Safety Commission has ordered the recall of 134 models of Kidde fire extinguishers manufactured between January 1, 1973 and August 15, 2017, including models that were previously recalled in March 2009 and February 2015. The extinguishers were sold in red, white and silver, and are either ABC- or BC-rated. The model number is printed on the fire extinguisher label. For units produced in 2007 and beyond, the date of manufacture is a 10-digit date code printed on the side of the cylinder, near the bottom. Digits five through nine represent the day and year of manufacture in DDDYY format. Date codes for recalled models manufactured from January 2, 2012 through August 15, 2017 are 00212 through 22717.
